Please read these terms and conditions. You should understand that by ordering any of our Services, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference.
1. General
a. We, us, our or Company refers to Waagroo Pty Ltd, ABN 91 619 000 538 trading as SafeEco pest solutions.
You, your or Client or customer refers to the person or persons requesting Pest Control services as specified in the service agreement.
Technician refers to an employee or contractor working under The Company.
b. This agreement may only be amended in writing signed by both parties.
c. A reference to ‘writing’ or ‘written’ includes electronic mail.
d. If any provision of this agreement is illegal, invalid, or unenforceable it may be severed without affecting the enforceability of the other provisions.
e. Each indemnity in this agreement is a continuing obligation separate and independent from the other obligations of the party giving the indemnity and survives termination or expiry of this agreement.
f. This agreement is governed by the laws of the State or Territory where the Services are being provided to the Customer and the parties submit to the jurisdiction of the courts of that State or Territory.
2. Agreement
a. This agreement supersedes and replaces all previous agreements between the parties in relation to pest control services and contains the entire agreement between them as to its subject matter. To the extent permitted by law, SafeEco expressly excludes all warranties, guarantees, representations and conditions except as may be made by SafeEco to the Customer in writing.
b. By availing our services or placing an order with us (whether through our site, over the phone, messages, social media, signing this document or by other means), you accept these terms and warrant that you are at least 18 years old and legally capable of entering binding contracts are at least.
3. Access and Safety
a. The Client must ensure that SafeEco staff and other authorised personnel have full and safe access (free of any health and safety hazards and risks) to the relevant areas of the premises and all facilities such as water and electricity that SafeEco may reasonably require to provide the service.
b. The Client must advise the SafeEco technicians before the commencement of the Service of any health and safety risks including the presence of asbestos. The Customer must also provide SafeEco with all necessary information, instructions, documentation, and co-operation required. SafeEco will comply with all reasonable security and safety instructions of the Customer while present at the Customer’s premises.
4. What you must do
a. You must advise us of any pets or of any personal or family/staff allergies, or other health concerns. Any persons who may be particularly sensitive, or who may suffer from allergic reactions, should, as a matter of precaution, remain out of the premises for a period of twenty-four (24) hours and not return until after the premises have been fully ventilated. Leave any air-conditioners on ‘vent mode’ (so they circulate outside air into the building) for a period of at least four hours after the treatment or after re-occupying.
b. You must remove or protect any people, animals, birds, or fish during the treatment period. All pets/animals should be kept away from treated areas until dry and any odour has cleared. Cover and seal up any fish tanks and ponds.
c. For effective application we recommend all furniture such as wardrobes and cupboards must be emptied and moved away from the wall to enable spraying, all drawers or doors must be unlocked and open. All floors and areas to be treated must be clear of any items with carpets vacuumed, including behind furniture that has been moved ready for treatment, unless advised otherwise.
d. For fleas, please ensure any domestic pets have been examined and if necessary, treated for fleas by a vet.
e. Leave all doors and windows closed for safe and effective application before and during the treatment and keep closed until the odour has cleared. This could take three (3) to twenty-four (24) hours in some cases. This is done to avoid any over spray and odour entering the building.
f. You must cover all food items and all food utensils or any other sensitive item prior to a treatment, and follow any additional recommendations made by pest management technicians.
g. You must observe any verbal advice provided by our firm or our licensed technician at the time of treatment. It is for our and your safety, safety of other people, pets, and environment.
h. You must avoid contact with treated surfaces until the insecticide has dried. This could take one to three (1-4) to twenty-four (24) hours in some cases.
i. Should you suspect anyone has come in contact with a treated area and has been affected in any way contact the Poisons Information Centre on 13 11 26 and have this notice with you.
j. When gaining access to or working in the roof void and/or subfloor areas, overalls and gloves and a respirator should be worn to avoid contact with any insecticidal products. The overalls and gloves should be washed immediately and separate from other washing or disposed of as soon as practicable.
k. You must not vacuum, mop, or wash down any non-food preparation surfaces, floors for a period to two weeks after the treatment was carried out.
l. Comply with advice and recommendations provided on a service report after the service to the customer to control and minimize reinfestation. These may cover hygiene, housekeeping, stacking, storage, safety, and maintenance.
m. FOR YOUR OWN SAFETY, you must not move or touch any gel bait or monitor traps. Where live humane traps are used you hereby agree to inspect each trap at least every morning and if a rodent has been caught you must contact us immediately or arrange for a suitably qualified person to release it into a suitable location or contact the nearest veterinary clinic to arrange for humane killing.
5. Pest Inspection and Treatment
a. You must leave the property during treatment and remain outside sprayed areas for at least 1-4 hours or up to 24 hrs depending on the treatment to enable the applied pesticide to dry and to avoid risk of contact or inhalation of any mist. If you re-enter the premises within this time, the treatment will be compromised and may pose a health hazard.
b. On arrival at the premises, we shall determine, at our absolute discretion, whether the premises has been sufficiently prepared in accordance with paragraph 3 above. If we determine that it has been well prepared, we shall treat it in accordance with the terms of this agreement.
c. If we determine that it has been reasonably prepared, we shall treat it, but you will be charged for any additional visits, as the treatment will be compromised.
d. If we determine that it has not been reasonably prepared, we may refuse to treat it. In this event, we will offer you the opportunity to book an alternative appointment at no extra cost.
e. We reserve the right to decline to carry out the treatment if we believe that it may impose risk to people, property, pets, or children.
f. The pest inspections undertaken as part of the service will be based upon a visual inspection only limited to those areas and sections of the premises fully accessible and visible to the technician at the time and on the day of the inspection. Furniture, equipment, fittings, and stock may conceal evidence of some pests that can only be revealed when these items are removed. The treatment will cover only those pests and areas described in this agreement. All other pests are excluded unless agreed by SafeEco in writing.
g. SafeEco will deliver the Service in a competent and professional manner considering these terms. The ongoing effectiveness of the pest control provided depends on the customer implementing SafeEco hygiene, housekeeping, sanitization, and property maintenance recommendations provided to the client.
h. The Customer acknowledges that pest treatment may also be rendered ineffective by disturbing treated areas, building alterations, renovations and introducing untreated or infested materials to the property that encourage pest activity.
i. Failure to follow recommendations provided by SafeEco in these terms and conditions, service agreement or at the time of inspection/treatment will void any free service warranty period initially provided.
j. The service does not include the removal of any dead rodent carcases and we shall not accept any liability for not doing so.
k. Only Pest Management agents/products approved by the Department of Primary Industry and/or the Australian Pesticides and Veterinary Medicines Authority (APVMA) and registered for use within the relevant State or Territory will be used.
l. While every care will be taken, (Pro Pest Control Australia) will not be held liable should staining of timbers, fabrics, wall coverings, floor coverings or any other articles occur.
m. Where concrete drilling and or cutting is required; no liability is accepted should damage result to concealed services such as power, gas, water, etc. You indemnify us against any costs that may arise from such possible damages. You should provide clear and accurate plans before we commence any such site works. (No rectification works are provided for unless mentioned in the Quotation). Customers will be responsible for identifying the location of all utility services to the property including water and drainage pipes, electrical and telephone cables, gas pipes etc. SafeEco will exercise due care in performing any drilling or cutting but the Customer will be liable for any damage caused by penetration to any such services unless caused by the negligence of SafeEco.
n. The Company shall endeavour to minimise the negative impact of the pest control services on the environment and shall make every endeavour to safeguard health and safety of people and animals in the property against any perils of using pesticides and nationally recognised methods of treatment appropriate to the severity of infestation or threat of infestation.
o. The Company shall ensure that Technicians who apply pesticides in the property, must be sufficiently trained to carry out the pest control services correctly and safely.
6. Payment terms
Full invoice amount is payable by the Customer to SafeEco for the Service. Prices are inclusive of GST. The Fees are payable on the day the Service is rendered. SafeEco will provide the Customer with an electronic tax invoice on the date of the Service, Where the Customer authorises a credit card or direct debit to a bank account, a charge for the Fees will be processed on the day the Service is rendered.
7. Cancellation Fees
a. Your appointments and well-being are very important to us. We understand that some events in life are unexpected, if you need to cancel your appointment, we respectfully request at least 48 hours’ notice.
b. Any cancellation or reschedule made less than 48 hours will result in a cancellation fee of $80.
c. If you are more than 30 minutes late for your booked service, we may not be able to accommodate you. In this case, the same cancellation fee of $80 will apply. We will do our very best to reschedule your service for another time that is convenient to you.
d. In the event of a true, unavoidable emergency, we may waive a cancellation fee. We may ask for appropriate evidence.
8. Warranty
a. Unless specific written arrangements have been provided, the full contract price shall be due and recoverable by on commencement of works, as detailed within the Quotation. Any FREE Service Period (Warranty) shall become null and void unless all monies due and payable have been paid in full.
b. We agree to provide you with a remedial treatment(s) as may be required to the nominated property, AT NO COST TO YOU, as per the term of the FREE Service Period. It is your responsibility to notify us of the signs of the suspected pest infestation at the earliest possible to avail free service benefits. Remedial treatment(s) will only be carried out to affected areas.
c. No responsibility can be accepted, nor warranty expressed or implied, for any damage or consequential losses that may occur as the result of past, current, or future pest activity.
d. The proposed treatment only applies to the pest species named on the Quotation issued. We provide dependable 6-month warranties for the majority of our General Pest services including German Cockroaches. Pests include German cockroaches, bed bugs, carpet moths, bees, wasps, webbing spiders and existing ant infestations. This program does not provide for a Pest Management Program against untreated pests.
e. Warranty conditions and lengths may vary due to several factors including the type of pests treated, type of property, or hygiene and housekeeping conditions at the property. Your warranty will be confirmed in writing by your technician on the day. No external areas are covered by a warranty. This includes non-habitable areas such as garages, sheds, and outbuildings. Please note that warranties are in place to rectify a pest re-infestation. A sighting of one insect does not constitute a re-infestation. If a re-infestation is not observed by our technician during a warranty call-back, a $80 call-out fee may be charged.
*Please allow at least 3 weeks post-service before you activate your warranty. This window of time allows our products to have their full effect*
9. Liability
To the extent permitted by law: -
(a) SafeEco will not be liable for any loss of profits or revenue, loss of business, wasted expenditure or any form of indirect or consequential loss arising out of or in connection with this agreement, the supply of the services, the equipment, or the sale of any goods.
(b) Where a claim relates to a guarantee or warranty under the Australian Consumer Law, SafeEco’s total aggregate liability to the Customer under or in relation to this agreement (including in contract, negligence, tort or any common law or statutory right) is limited at SafeEco’s option to:
(i) In relation to claims relating to services, the resupply of the services or the costs of resupply of the service; or
(ii) In relation to claims relating to goods, the resupply of the costs or the cost of re supply of the goods.
(c) In all other circumstances, the liability of SafeEco to the Customer (including in contract, negligence, tort or any common law or statutory right) under this agreement will not exceed the fees received by SafeEco from the Customer pursuant to this agreement.
10. Liability to Third Parties
All reports provided by SafeEco in relation to the Service are provided solely for the benefit of the Customer named in the report. Neither this agreement nor any report may be assigned by the Customer to another person or relied upon by any other person without the prior written approval of SafeEco that may be given conditionally or withheld.
11. Privacy and Credit Reporting
a. The Client authorises SafeEco, its Personnel or any related entities of SafeEco subject to complying with the Privacy Act 1988, to use and disclose the personal information of the Customer for any purpose connected with this agreement. Where the Customer is provided with credit, customer’s application for credit under this agreement and, if the application is successful, to manage the credit account until the credit account is repaid in full and closed. The client authorise SafeEco to do any of the following to assess the client’s application for credit under this agreement:
(i) Obtain credit reports in respect of the Customer and its related entities from credit-reporting agencies. Seek and/or disclose information about the Customer and its related entities (including any information about their credit worthiness, credit history, standing or capacity) which credit providers are permitted by the Privacy Act 1988 to supply, obtain or receive.
(ii) Disclose information about the application for credit under this agreement and, if the application is successful, about the credit account and any credit provided to a credit-reporting agency to obtain information or credit reports.
(iii) Disclose information including identity particulars, the fact that the Customer has applied for credit and details of payments which are overdue more than sixty (60) days to credit-reporting agencies and other credit providers.
(iv) Disclose information about the Customer and its related entities to any person considering acting as a guarantor of the Customer.
